
DHAKA, Jan 05, 2022 (BSS) - The High Court (HC) today issued a rule asking
authorities concerned to explain as to why it shall not issue an order to
formulate a policy over polygamy for the sake of protecting family life.
The court also asked officials concerned to explain as to why it shall not
declare illegal the rules that allow polygamy without ensuring equal rights
of all the wives of the same husband.
A High Court division bench of Justice M Enayetur Rahim and Justice Md
Mostafizur Rahman passed the order after holding hearing on a writ filed in
this regard.
The court asked secretaries of both the divisions of the Ministry of Law,
Justice and Parliamentary Affairs and Ministry of Religious Affairs Secretary
to reply the rule.
Supreme Court lawyer Ishrat Hasan filed the writ, challenging the
concerned section of The Muslim Family Laws Ordinance, 1961. Advocates Ishrat
Hasan and Jamiul Haque Foysal moved the plea before the court. Deputy
Attorney General Bipul Baghmer stood for the state.
