State to appeal against HC verdict on separate SC secretariat: AG

DHAKA, April 08, 2026 (BSS) - Attorney General Md Ruhul Quddus Kazal today said the state will file an appeal against the High Court (HC) verdict directing the establishment of a separate secretariat for the Supreme Court (SC).

"The decision to appeal was taken as the verdict involves constitutional questions. When the High Court disposes of a case involving constitutional interpretation, it grants a certificate allowing a direct appeal to the Appellate Division of the Supreme Court," he said while responding to questions from journalists at his office.

"In this judgment, the High Court itself mentioned that constitutional questions and interpretations are involved. Since the court granted such a certificate, we will file a direct appeal," he said, adding that the appeal would be lodged with the Appellate Division as soon as possible.

The Attorney General further said the effectiveness of the High Court verdict would ultimately depend on the final decision of the Appellate Division. He also said discussions had already been held with the government, and authorities would wait for the Supreme Court's final verdict on the matter.

Earlier, a High Court division bench delivered the judgment on September 2, 2025, following the final hearing of a writ petition filed by seven Supreme Court lawyers.

In the verdict, the court declared Article 116 of the current constitution contradictory to the constitution and void, restoring the original Article 116 of the 1972 constitution. The court also directed the establishment of an independent and separate secretariat for the Supreme Court within three months.
